HHS Allows Employers to Switch Insurance Without Losing Grandfathered Status
On Nov. 15, amendments to the law were published which allow employers to switch carriers and still maintain grandfather status as long as they kept their benefits essentially the same (see § 147.140 Preservation of right to maintain existing coverage, pages 34 – 35).
Read HHS Fact Sheet on regulations to maintain health plan status as a grandfathered plan under Affordable Care Act. Plans will lose their grandfather status if they choose to significantly cut benefits or increase out-of-pocket spending for consumers.
